Topical conference themes chart major developments in recent years, particularly the insolvency of major components of business and financial environments. These include financial and insurance institutions, large conglomerates and groups of companies, as well as sovereign bankruptcy and the insolvency of state-run bodies. Also highlighted will be the regulation of insolvency procedures and practices involving large bodies and institutions, the special challenges of designing insolvency systems and procedures to cater for large-scale enterprises, the role of regulatory and other oversight bodies in the maintenance and supervision of insolvency processes, as well as related issues involving interested participants.

High-profile speakers representing both the academic and practitioner communities will present papers. The first day is devoted to Banking and Financial Services, with a joint paper by Professor Andy Campbell (Leeds), Paula Moffatt (Nottingham Trent) and Rebecca Oliver (Norton Rose) on “Protecting Vital Financial Services on Bank Failure”, followed by papers from Dr Jessica Schmidt (Jena) on “ESRB and ESMA as the EU’s Regulatory Answer to the Crisis in the Financial Sector: A Critical Analysis” and Michael Schillig (King’s College) on “Bank Resolution Regimes in Europe”. The second session on this topic will feature further contributions from Martine Gerber-Lemaire (OPF Partners, Luxembourg) on “Decisions Concerning the “ Failure” of Three Icelandic Banks: Three Different Pragmatic Approaches” and a comparative perspective from Virginia Torrie (Kent) on “Group Insolvency of the Third-Party Asset-Backed Commercial Paper Market in Canada”. They will be joined by Dr Alexandra Kastrinou (Westminster).

The second day opens with a session on Enterprise and Group Insolvencies in which papers will be given by Professor Catarina Serra (Minho) on “The Rescue of Large Corporations: Is the Portuguese Insolvency Act suitable?”, Richard Sheldon QC (3/4 South Square) on “Hell as explained - A case study of Hellas Telecommunications SARL”, Professor Aishah Bidin (University Kebangsaan Malaysia) on “The Rescue of Large Companies – A Malaysian Perspective” as well as Professor Xian-Chu Zhang (Hong Kong University) on “Too Big to Fail with Chinese Characteristics”. A final session on Designing Insolvency Systems will follow, featuring papers by Dr Rodrigo Olivares-Caminal (Queen Mary) and by Rolef de Weijs (Amsterdam) on “Ways around creditor and shareholder holdout behaviour: The Problem of the AntiCommons”. A further speaker joins us from the World Bank.
