Exceptionalism in the US Law of International Arbitration:
Insights from the Restatement

The American law governing international commercial and investment arbitration is currently being subject to the greatest scrutiny it has undergone since adoption of the Federal Arbitration Act back in 1925. The occasion is the first-ever Restatement of the US Law of International Commercial Arbitration, sponsored, as are all US Restatements, by the American Law Institute.

A special benefit of producing a US Restatement on a distinctly international law subject is the opportunity it provides to gauge the exceptionalism of American law in this domain and, to the extent it exists, its origins. George Bermann will share with us a series of reflections on that subject drawn directly from the ongoing work on the Restatement whose he is the Chief Reporter.
