L'Istituto svizzero di diritto comparato, in collaborazione con la Facoltà di Giurisprudenza dell'Università di Neuchâtel, organizza la 28° giornata di diritto internazionale privato che si terrà il 27 maggio a Losanna sul tema: "Le banche e le assicurazioni nei rapporti con i terzi e le novità in materia di insolvenza internazionale." La mattinata sarà dedicata ai nuovi sviluppi dell'insolvenza internazionale, con una presentazione del progetto di revisione della legge federale sul diritto internazionale privato, l'impatto del fallimento sui procedimenti civili o di arbitrato, nonché le questioni relative al fallimento internazionale nel settore bancario. Il pomeriggio presenterà il tema dei rapporti giuridici che coinvolgono tre parti, con particolare attenzione alla situazione delle banche e delle assicurazioni. Questo tema ingiustamente negletto nel diritto internazionale privato, non è solo di grande importanza pratica, ma anche di interesse teorico, perché questa situazione mette in crisi la struttura bilaterale della maggior parte delle norme di conflitto, oltre a rappresentare una minaccia concreta per la prevedibilità del diritto. I recenti sviluppi in Svizzera e nell'UE saranno affrontati, mettendo anche in evidenza la questione molto attuale del diritto dei terzi ad ottenere informazioni dalle banche nel quadro delle successioni. L'Institut suisse de droit comparé en collaboration avec la Faculté de droit de l'Université de Neuchâtel, organise la 28e journée de Droit International Privé, qui se déroulera le 27 mai prochain à Lausanne sur le thème : "Les banques et les assurances face aux tiers et les nouveautés en matière de faillite transfrontalière". La matinée sera consacrée aux nouveautés en matière de faillite internationale, avec une présentation du projet de révision de la Loi fédérale sur le droit international privé, des impacts pratiques d'une faillite sur une procédure civile ou d'arbitrage, ainsi que des questions liées à la faillite internationale en matière bancaire. L'après-midi présentera la thématique des relations juridiques qui mettent en cause trois parties en portant une attention particulière à la situation des banques et des assurances face aux tiers. Ce thème, peu développé en droit international privé, revêt non seulement une grande importance pratique mais aussi théorique puisque ce type de situation remet en cause la structure bilatérale de la plupart des règles de conflit, tout en posant un défi parfois insurmontable à la prévisibilité du droit. Les développements récents en Suisse et dans l'UE seront abordés, et en particulier la question très actuelle du droit des tiers d'obtenir des renseignements des banques dans le cadre successoral. The Swiss Institute of Comparative Law, in collaboration with the Faculty of Law of the University of Neuchâtel, will organize the 28th Conference of Private International Law: "Banks and insurance relations with third parties and the Developments in cross-border bankruptcy". The conference will take place in Lausanne on 27th May. The morning session will present recent developments in international bankruptcy, with a particular focus on the draft revision of the Swiss Federal Act on Private International Law, the practical impact of bankruptcy on civil proceedings and arbitration, as well as issues of international bankruptcy in banking. The afternoon session will clarify the theme of the legal relationships that involve three parties, with particular attention to the situation of banks and insurance companies against third parties. This topic, unduly neglected in private international law, is not only of great practical importance but is also very interesting for PIL theory because third party relationships challenge the often bilateral structure of conflict rules, at the same time posing insurmountable challenges to the predictability of the law. Recent developments in Switzerland and the EU will be addressed, including the issue of third party's right to obtain banking information in the context of successions.
